YOUR BANKRUPTCY COURT HEARING

Introduction:   You will have to attend at least one court session with the Bankruptcy Court – it is called the Meeting of Creditors.   There is no judge present.   A “trustee” is appointed in your case.   She/He reviews the papers you signed and filed.   The trustee will ask you to verify that the information is correct.

I will be there with you.   This is another reason you need an experienced bankruptcy attorney.   I’ve been to thousands of these hearings.

  •    In Chapter 7, the trustee will attempt to determine if you have any valuable assets that could be sold to pay your unsecured creditors.

*** Please Note: in Illinois, the Chapter 7 Trustee wants you to bring your most recent paystub to court and a copy of your bank statement showing how much money you actually had in your bank account on the date you filed bankruptcy.

  •    In Chapter 13, the trustee will discuss your proposed Chapter 13 Plan with you and make sure that payments have begun.

Where is court held?

In the Illinois Quad Cities, court is held at the old post office in downtown Rock Island at 211 - 19th Street.
